A man from Kilgore has filed a lawsuit alleging that a driver who attended to make a pass in a no passing zone caused an accident in which he was injured. According to the Southeast Texas Record, the lawsuit alleges that the man, who was driving a Harley-Davidson motorcycle at the time of the crash, was traveling in the same direction as a woman driving a Toyota car. The man intended to make a left turn and was hit by the woman.
The lawsuit alleges that the woman was negligent in several regards. It alleges that she didn’t keep a proper lookout, that she did not control her speed, that she didn’t slow down in time to avoid the collision, she didn’t turn her vehicle to avoid the collision and that she didn’t adhere to the no passing zone.
The motorcycle rider suffered multiple injuries as a result of the crash, according to the lawsuit. The woman was, at the time, driving a company vehicle and, because of that, the lawsuit is actually filed against the company for which she works.
Motorcyclists and Cars
Unfortunately, many drivers in passenger vehicles driving in a way that seems to indicate that they don’t understand that motorcyclists have the exact same rights as any other vehicle on the road. This creates situations where motorcyclists are put in danger of being seriously injured or losing their lives. Even though motorcyclists do have the same rights as anyone else on the road, they do not have the same degree of protection as a driver in a passenger car. While helmets and close that are able to hold up to hitting the pavement can help, motorcyclists are still in mortal danger whenever they are involved in a collision with a motor vehicle.
