If you read up on lawsuits, you’ll find that rear end car crash lawsuits are very common. There are very understandable reasons why this is the case. Rear end collisions tend to cause a lot of damage to the vehicles involve and oftentimes the drivers, as well. There are reasons other than the damages, however, that these types of accidents tend to lead to so many lawsuits.
Negligence
In many cases, the driver who caused the accident was negligent. Rear end collisions oftentimes occur because one of the drivers was not paying attention and keeping a lookout on the road as they were driving. This can be the case with the driver who struck the car in front of them or the driver who was struck from behind.
When someone is hit from behind, there is a chance that the accident was caused because the driver behind the driver who was struck was not paying attention. They may not have noticed the turn signal or the brake lights on the car in front of them and, thus, slammed into the car when it made what should have been an entirely predictable turn and stop maneuver.
Because of this, many of the drivers who actually hit the car in front of them end up being sued.
The driver in front may also be at fault, however. If they failed to apply their turn signal or failed to give adequate warning before they turned, they may have actually caused the accident. This is something that the other driver can sometimes successfully sue over.
Watch Out
When you’re out on the road, watch out for situations where rear end collisions are likely to occur. Parking lots are very common locations for these. Be aware if you’re in the right lane and there are a lot of turn offs that drivers may take. You should also be aware if there are a lot of parking spaces on the side of the road because the driver in front of you may suddenly try to get into one they spot with very little warning.
