Police have since filed a second felony intoxication manslaughter charge against 21-year-old Shana Lee Elliott, after Guerrero’s unborn baby died at St. David’s South Austin Medical Center. Elliott is currently being held on $185,000 bail, but bail has not yet been set in regard to the newest charge of intoxication manslaughter.
According to San Marcos police, Elliot had been drinking alcohol while floating the river prior to the car accident.

SAN MARCOS, TX (08/02/2016) — Fabian Guerrero died in a DWI-related crash that also injured his wife, Kristian, and killed their unborn child on Tuesday evening.

According to authorities, 23-year-old Fabian Guerrero-Moreno was killed, and his wife, 24-year-old Kristian Nicole Guerrero, was seriously injured in a two-vehicle accident that occurred in the 1700 block of State Highway 21 in San Marcos, Texas.
Police reported that at around 6:05 p.m., 21-year-old Shana Lee Elliot was traveling eastbound in a Chevrolet Impala when she veered into westbound traffic and struck a Toyota Corolla, driven by Kristian Guerrero.
Fabian Guerrero (of Bryan), who was riding in the front passenger seat, was was pronounced deceased.
Kristian Guerrero, who was five months pregnant at the time, was transported to St. David’s South Austin Medical Center for treatment. Her unborn child did not survive. Kristian remains hospitalized in serious condition.
Elliott was arrested and charged with one count of intoxication manslaughter and one count of intoxication assault.
Commentary
Reports of this nature are especially devastating, and we offer our condolences to those affected by this tragic accident. While the at-fault driver has been charged with intoxication manslaughter and intoxication assault, the crash is still under investigation and she could face additional charges as well as a separate civil lawsuit brought by the victim’s family.
